1. Contract Partner, general definitions
(1) This service is operated by Pixtura S.r.l., an imaging and imaging services company based and registered in Ivrea, Italy.
(2) The website allows you to order for postal delivery, the production of photographs, or photographic gifts from images you upload to our service system.
(3) These terms and conditions apply to all customers/visitors, and are form the basis of every agreement made between us and you (the customer). Please read these Purchase Terms carefully because they form a contract between Sirioprint and our customers.
(4) These conditions may be modified by us at any time and supersede all previous terms and conditions published on this site.

2. Ordering Services
(1) We shall use all reasonable endeavours to maintain the quality and operational status of the website, and online services which we may provide to you, although accept no liability for losses of any kind, including but not limited to economic or goodwill losses during periods of maintanance, planned or unplanned
(2) You may upload digital images to the web site yourself or email them to us to upload to the web site and store. Images uploaded to the web site or emailed to us for uploading are preferred by us to be digital images in JPEG format (.jpg), although we do accept and work with other files formats.
(3) Once you have placed an order for any goods or services via this web site (including any order for product or services), the order will not be treated as having been accepted until you receive confirmation from us that this is the case. This confirmation may be by email. For the customer any order is legaly binding after having agreed to these terms of purchase and confirmed the purchase on the order confirmation page.

3. Prices
(1) All indicated prices are including taxes but excluding packaging anf posting.
(2) Costs for postage and packaging will be calculated separately during the order process according to our price list on this web site.
(3) All indicated prices apply to the date of an order. By updating our website, all previous price lists become invalid. The relevant prices are those which applied to the date of an order.

4. Methods of Payment
(1) The customer may choose a method of payment during the order process. The method of payment can not be changed afterwards.

5. Returns
(1) Goods may be returned to us (in accordance with your statutory rights), if they are delivered to you in a defective state, or do not match the descriptions of the goods on our website, or do not match samples supplied by us.
(2) You are required to inform us within seven days of receipt of goods if it is your intention to reject any goods. You will be emailed specific instructions which are unique to your return.
(3) Personalised items (such as Canvas Photos) which are delivered as described, and in good condition may not be returned if not damaged through transport or faulty by production. We reserve the right to charge for re-posting returned orders which have been especially produced to meet your personal requirements.

6. Delivery
(1) The order will be delivered to the delivery address stated and confirmed by the customer during the order process. The customer is resonsible for the correct and complete statement of the delivery address.
(2) Delivery times are stated as a guide only, we cannot be responsible for items deleyed or lost due to courier failure.
(3) Sirioprint may despatch and deliver orders which consist of more than one item as partial shipment.

7. Reproduction rights
(1) We reserve the right not to reproduce any images or other material which contain offensive or inappropriate content.
(2) In submitting the order form the customer confirms that they own the rights to their respective photo or have obtained the relevant written permission. You retain all intellectual property rights, including copyright, to the images that you have submitted to us for reproduction.
(3) You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses arising out of any claim regarding infringement of any third party's copyright, trade mark or other intellectual property rights due to the processing, printing or other dealing with by us in accordance with our stated services by you or on your behalf.
(4) We reserve the right to refuse any further services to anyone who breaches these terms.

8. Data protection
(1) Personal data provided to us through this web site will only be used in accordance with our privacy policy. Please read through this carefully before proceeding. By providing your personal data to us you are consenting to its use in accordance with our privacy policy.
(2) As a general rule the information which you supply will be processed purely for the purpose(s) for which it is supplied and collected. However, we may on occasion use your information for the purpose of providing information to you about special offers, services, products and features on our website which we consider may be of interest to you and for other related marketing purposes. We may share your information with reputable third parties for the purposes of fulfilling any order which you may make. Otherwise, we will not reveal your personal or contact details to any third party in any circumstances other than with your specific consent or where not to do so would involve breaking the law..
(3) Our web site logs information about your visit that is automatically recognized by the Web server, such as the link that brought you to us (i.e. a link from a search engine). They also provide information about the pages you visited whilst on the site. We use this information for internal review to improve the content of our web site. It is then discarded, and is not shared with other organizations for commercial purposes. No contact information or personal data is collected via our web site logs.

(1) You warrant that you are the legitimate copyright owner or licensee of all the images that you submit to our service, and that you are authorised to send/transmit images to us for work and/or reproduction. You agree not to infringe the intellectual property rights of any third party including any copyright licensor.
(2) We claim no ownership of the intellectual property in your images, but you grant us a royalty-free license to store, print, download, copy, post, or distribute your images in the course of our business or contracts with you.

10. Law and jurisdiction
(1) These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with European law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the European courts will have exclusive jurisdiction over such dispute.
